Maritime Arbitration Procedure

Maritime Arbitration Process

  • A. Arbitration Agreement

    You may request for arbitration if there is the maritime arbitration clause in the contract or a separate maritime arbitration agreement.

  • B. Request for Arbitration

    1. ① Submit the Request for Arbitration to the Asia-Pacific Maritime Arbitration Center
    2. ② Advance the Arbitration Costs
    3. ③ Commencement of the Arbitration Procedure

  • C. Composition of the Arbitral Tribunal

    Compose the Arbitral Tribunal of one person or three persons depending on a separate agreement or the Secretariat's decision

  • D. Arbitration Hearing

    1. ① Submit the Request for Arbitration to the Asia-Pacific Maritime Arbitration Center
    2. ② Advance the Arbitration Costs
    3. ③ Commencement of the Arbitration Procedure
    4. ④ Generally held two ~ three times (in principle, one oral hearing for the expedited process)

  • E. Arbitration Decision (Settlement Decision)

    1. ① Arbitrator's arbitration decision
    2. ② Settlement decision in case of the parties' agreement
    3. ③ The arbitration decision and the settlement decision represent the final and conclusive resolution of the dispute and they have the same effect as the court's final ruling.
