Administrative fees

The administrative fees are determined by applying a certain rate to the claimed amount. The minimum fee is KRW 50,000 and the maximum fee is KRW 150 million.

Expense

It refers to expenses incurred by arbitrators and arbitration secretary, expenses incurred by evidence, witness or appraiser, inspection or investigation expense, recording or stenographic record expense, interpretation or translation expense, and any and all other expenses incurred in arbitration. In case of the party's request, the Claimant shall advance the expenses unless decided to the contrary by the parties.

Arbitrator's fees

The arbitrator's fee is determined between the minimum amount and the maximum amount by reflecting the rate in the arbitrator's fee table of the domestic arbitration rules fee table (see annexed) in accordance with the claimed amount. The Secretariat generally requests to advance the average amount between the minimum amount and the maximum amount and afterwards increases or decreases the amount in consideration of the complexity of dispute; in most cases, it selects the average amount.

For cases with the claimed amount of KRW　200 million or less, in order to reduce the parties' burdens, the minimum amount in the arbitrators' fee table is imposed for the arbitrator's fee. However, where the parties agreed to have three persons as the arbitrators, etc., the average amount of the arbitrator's fee is calculated as the arbitrator's fee.

Rules for Return of Fees

Where the arbitration request is ended prior to the arbitral decision due to a party's withdrawal, etc. prior to the arbitral decision, the fees shall be returned as follows.

• The arbitration cost is categorized into the administrative fees, expenses, and arbitrator's fees.
• The administrative fees are calculated by the fees determined under the Arbitration Rules in accordance with the arbitration claimed amount.
• The Claimant, at the time of the arbitration request's receipt, needs to pay the arbitration cost along with the submission of the Request to the Secretariat.
• After the payment of the arbitration cost, the Secretariat notifies the commencement of the arbitration process. The arbitration cost is also imposed in case of counterclaims. For the arbitration cost paid, the amounts to be borne between the parties in dispute are determined pursuant to the Arbitral Tribunal's final decision.
