At the time of receipt of arbitration request, the Claimant needs to pay the filing fee of KRW 1 million (excluding VAT) to the Secretariat along with the submission of the Request. Once the filing fee is paid, the Secretariat notifies the fact of receipt of arbitration request and the date of receipt to both parties and informs the Respondent to submit the Answer within 30 days from the date of receipt of the receipt notification and the Request. The filing fee is imposed on the counterclaims as well; the filing fee paid is aggregated to the arbitration costs and the amount to be borne between the parties in dispute is determined in accordance with the Arbitral Tribunal's final decision. Recently, in order to reduce the burden of arbitration costs in small claims cases, where the claimed or counterclaimed amount is KRW 200 million or less, the filing fee is exempted.

The Secretariat combines the claimed amount and the counterclaimed amount in order to calculate the amount in dispute and then requests for the advance of arbitration costs accordingly.

The Secretariat equally divides the estimated arbitration costs and requests each party to advance its share. However, where one party fails to make such advance, the other party may advance the failed party's share.

The administrative fees increase in accordance with the amount in dispute and the maximum amount is capped at KRW 150 million.

The arbitrator's fees are not calculated in fixed amount. Only the minimum fee and the maximum fee are determined in accordance with the amount in dispute; the final fee is determined for each case between the minimum and maximum amount. Generally, the Secretariat requests the parties to advance the average amount between the minimum and maximum bands of the arbitrator's fees at the time of receipt of arbitration request. In most cases, the average amount is determined as the final arbitrator's fees.

While hearing by a sole arbitrator is a rule, where the parties agree to hearing by three arbitrators or the Secretariat decides that hearing by three arbitrators is appropriate in consideration of the parties' views, amount in dispute, complexity of dispute, and other factors, hearing by three arbitrators is possible. Thus, where the number of arbitrators changes, the arbitrator's fees incurred therefrom can also change.

At the same time, for the arbitrators in expedited process cases with the amount in dispute of KRW 200 million or less, in accordance with Article 1(1) of the International Arbitration Rules Annexed Table 2, the minimum amount of the Arbitrator's Fees Table shall be imposed as the arbitrator's fees. However, for the arbitrators under Article 45(1) of the International Arbitration Rules (arbitrator of expedited process cases appointed by the Secretariat), the average arbitrator's fees under the following Arbitration Cost Table shall be imposed as the arbitrator's fees.
